    Conditions of Participation for Competition Private Label Trial Weeks

    1. Organiser

    The organiser of the "Private Label Trial Weeks" competition on the Instagram and Facebook fan pages of zooplus UK is zooplus AG, Sonnenstraße 15, 80331 Munich (hereinafter: "Organiser").

    The competition is not supported by Facebook / Instagram and has no connection with Facebook / Instagram.

    2. Conditions for Participation

    Any person over the age of 18 who is resident in UK may participate free of charge and without any obligation to purchase. Employees of the organiser and their relatives as well as employees of the companies participating in this competition and their relatives are excluded from participation. Participation is only possible with the inclusion of these conditions of participation. The legal process is excluded.

    3. Competition Period

    The promotion period starts on Sunday the 16th of May 2021 and ends on Wednesday the 19th at midnight.

    4. Implementation and Processing

    Participants must comment on the post describing what kind of pet they have, and which zooplus brand their pet loves the most.

    There is no entitlement to participate. The organiser reserves the right to delete comments, in particular if the content does not meet the requirements of the competition and/or is of a xenophobic, sexual and or of an illegal nature.

    The participant agrees to be informed by the organiser by being tagged in a comment on the contest post in the event of a win. The organiser will ask the entrant to contact them via direct message, in order to provide his/her postal address and other necessary data in order to send the prize. Prizes will only be sent within the UK. If the respective winner does not get in touch with the information about the prize within 1 week after receiving the direct notification, a new winner will be selected.

    The organiser is entitled to terminate the competition at any time for good cause. Such cause shall be deemed to exist in particular if the course of the prize draw has been influenced in an inadmissible manner or an attempt has been made to exert such influence. In addition, the organiser is entitled to extend the competition or to offer prizes before the end of the competition.

    5. Prize

    The two winners will receive a surprise box each, containing zooplus private label products (either cat or dog).

    Winners will be selected at random. The prizes are non-transferable and cannot be paid out in cash or exchanged by the winner. The organiser is entitled to replace the respective prize at short notice.

    6. Exclusion of Liability

    Participants are solely responsible for the accuracy of the information provided to us. The participant is responsible for any claims by third parties if he/she uses material to which he/she does not own the rights or which otherwise violates applicable law. In this respect, the organiser shall be released from the obligation to pay damages by the participant.

    Claims for damages against the organiser in connection with the competition are excluded - within the limits of what is legally permissible - irrespective of the legal grounds, unless the organiser has intentionally or grossly negligently breached statutory obligations. Liability for incorrect information or descriptions of the prizes offered is - as far as legally possible - excluded. The prizes may differ in their presentation from the prizes presented in the promotional materials used for this competition.

    The organizer is not liable for the timely processing and transmission of registered run times and personal details via the Facebook/Instagram fan page, whether due to technical or other computer malfunction or other error.

    7. Data Protection

    Insofar as personal data of participants is collected within the scope of the competition, this data will only be determined, processed and used for the purpose of conducting the competition and will be deleted after the competition has ended. The participant expressly agrees to this. Further information on data protection can be found below.

    8. Tax

    If a withholding tax should be due, the organiser will pay this tax.

    9. Final Provisions

    Participation in the competition is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. In the case of consumers, this choice of law shall only apply insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence.

    Should any of these provisions be or become invalid, the validity of the remaining provisions shall not be affected. Instead of the invalid provision, the legally permissible provision that comes closest in economic terms to the meaning and purpose expressed in the invalid provision shall apply. The same shall apply in the event of a loophole in these Terms and Conditions of Participation.

    There is no opt-out possibility as the participation in the contest cannot be withdrawn according to the Terms and Conditions

You also have the right to rectification, erasure and restriction of data processing, as well as the right at any time to object to the processing of personal data or to revoke your consent for the processing of data or to request the transfer of data. For any information needs or requests, revocations or objections to the processing of data, please send an email to our Data Protection Officer or to the contact details above. In addition, you have the right to complain to a supervisory authority when violations of privacy occur.

    10. Special Information about the right to object

    You have the right, for reasons of your own situation, to object at any time to the processing of personal data pursuant to Article 6 (1) (f) GDPR (data processing based on a balance of interests). This also applies to profiling based on this provision within the meaning of Art. 4 No. 4 GDPR. for customer consultation and customer service and for sales purposes. If you file an objection, your personal data will no longer be processed unless zooplus proves compelling legitimate grounds for processing that outweigh your interests, rights and freedoms, or the processing is for the purpose of asserting, exercising or defending legal claims.

    2. Right to object to the processing of data for direct marketing purposes

    zooplus can also process your data for direct marketing insofar as we are allowed to under the law.

    You have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising, without incurring other than the transmission costs according to the basic rates.

    This also applies to the profiling, as far as it is associated with such direct marketing. If you object to the processing for direct marketing purposes, we will no longer process your personal data for these purposes. The objection can be made free of form.
