Facebook and Instagram Spring Competition

1 General Provisions

1. The organizer and sponsor of the " Facebook and Instagram Spring Competition" contest is zooplus UK.

2. The organizer declares that the contest is in no way sponsored, endorsed, administered by, or affiliated with any third party owned by Facebook or Instagram. Facebook or Instagram assumes no liability for the contest. All questions, comments, complaints, and claims related to the contest should be directed to the promoter and not to Facebook or Instagram’s owner or administrator. The foregoing disclaimer does not affect the promoter's liability to the contest entrant in connection with the contest entrant's participation in the contest.

2 Duration of the contest

1. The contest starts on 20th March 2024 at 08:15 am and finishes on 24th March 2024 at 23:59 pm.

2. The answers to the contest task referred to in 5 item 2 of the Terms and Conditions shall be submitted during the contest term, provided that the date, hour and minute of the publication of the comment with the contest answer under the contest Instagram and Facebook post counts.

3 The selection committee

1. In order to ensure proper organization and conduct of the contest, assessment of the correctness of the submitted contest works, as well as assessment and selection of the awarded contest works and the prize winners, the organizer shall appoint a selection commission composed of representatives of the organizer (hereinafter referred to as the "selection commission").

2. The selection committee shall consist of 2 persons.

4 Conditions for participation in the contest

1. Participation in the contest is voluntary and free of charge.

2. The contest is open to natural persons who have their place of residence in the territory of Great Britain, who have reached the age of majority and have full legal capacity.

3. The contest is organized in Great Britain.

4. You may participate in the contest only in your own name, i.e. it is not allowed to create a participation profile and make contest registrations on behalf of third parties.

5. Employees, members of the governing bodies and representatives of the organizer, the co-organizer and other third parties directly involved in the preparation and implementation of the contest, as well as persons who permanently work with the above-mentioned on a basis other than employment, as well as their closest family members, i.e. relatives in ascending and descending line, siblings, spouses, parents of spouses, persons living with them in a marriage-like relationship and persons who are in an adoption relationship with them, may not participate in the contest.

6. Participation in the contest and the related provision of personal data is completely voluntary. A person who wishes to participate in the contest (hereinafter "participant") is required to,

a. to familiarize himself/herself with and agree to the Terms and Conditions of the contest as set forth in these Terms and Conditions of participation;

b. to take note of the organizer's privacy policy, which can be viewed here: https://www.zooplus.co.uk/info/legal/privacy

7. The contest is open to persons who have their own Facebook or Instagram, created and maintained in accordance with the Facebook or Instagram terms and conditions (hereinafter "user account"), and an internet connection. It is not permitted for an entrant to participate in the contest through a fictitious user account, i.e. an account that is based on personal information other than the actual personal information of the natural person operating the account.

5 Basic rules and procedure of the contest

1. The contest will be conducted on the Instagram post on the fan page @zooplusuk and the Facebook post on @zooplusuk

2. The task of the participant is to like the post, follow/like @zooplusuk, comment a photo of their pet and tag two friends (Facebook) or like the post, follow @zooplusuk, like the three pinned posts, and tag two friends (Instagram).

3. Each participant can submit more than / one contest work, but only one contest work of a participant can be awarded. The participant can only participate in the contest from one user account, regardless of how many user accounts he has on Facebook or Instagram.

4. Only contest works may be submitted for the contest:

a. which are related to the contest;

b. which comply with the provisions set forth in these Terms and Conditions of participation;

c. to which the participant holds copyrights;

d. which do not contain trademarks, representations of third parties, advertising and promotional messages of competing companies.

5. Contest works that do not comply with the provisions stated in these conditions of participation will be excluded from participation.

6. The participant declares that the contest work submitted by him/her does not contain any content that violates applicable law or moral law, in particular that it does not violate the rights of third parties, including copyright, right to one's own image, right to privacy; that it does not incite violence and intolerance; does not contain any content that is harassing, offensive, vulgar, obscene, offensive to the feelings of others, including religious feelings; that it does not depict violence or racist content, violates the right to privacy or is otherwise inappropriate or promotes third party content.

7. The contest works admitted to the contest may be used, in accordance with 8 of these Conditions of participation, in promotional activities of the organizer. The organizer reserves the right to remove a contest work published on the fan page if it does not comply with the provisions set forth in these Terms of participation or for other important, justified reasons.

8. The selection committee is free to evaluate the contest works, taking into account the consistency of the contest work with the contest theme, its originality, ingenuity and creativity. It shall select one contest works from all contest works submitted during the contest period to be awarded (hereinafter "awarded contest works").

9. The winners of the contest are those participants whose contest works are evaluated the highest by the selection committee. Or: The winner will be drawn at random from all participants.

10. The result of the contest will be announced on the Facebook and Instagram page within 4 working days from the day of the contest termination and the contest winners (hereinafter "winners") will be notified about it directly in private Facebook and Instagram messages or under their comment / entry, with which the participant agrees.

11. The participant agrees that his first name and surname (or nickname) will be published in the comment under the contest entry on the Facebook page or username on the Instagram page for the purpose of announcing the contest results.

12. In order to confirm participation in the contest and receive the prize, the winner should contact the organizer within 5 days after the publication of the list of winners, or the sending of the private Facebook or Instagram message, through a private message on the zooplus UK profile and provide him with the information necessary for the delivery of the prize, such as first and last name and the exact address of correspondence. If the winner does not confirm his participation within the time and form specified above, or does not provide the name and address for delivery, which makes it impossible to deliver the prize, or provides false information, he will lose the right to receive the prize and the prize will remain the property of the organizer or another winner will be selected.

13. If applicable, the organizer will inform the co-organizer about the winner's data for the purpose of sending the prize. The organizer is responsible for the shipment of the prize.

14. The delivery of the prizes shall be carried out only within 40 days. The organizer shall bear the shipping costs of the prize.

15. Neither the organizer nor the co-organizer shall be liable for non-delivery of the prize due to the fact that the winner did not receive the prize or provided incorrect address data. In this case, the prize remains the property of the organizer.

16. The prizes, which remain the property of the organizer, may be awarded by the selection committee to other participants selected according to the guidelines of these conditions of participation.

6 Prizes

1. The prize shall be non negotiable or changed.

2. Each participant can win maximum one prize in this contest – there will be two overall winners, 1 on Facebook and 1 on Instagram. The prize consists of 1 £75 voucher to spend on www.zooplus.co.uk

3. The prize will be sent by the organizer by courier service to the address provided by the winner within 40 working days after receiving the winner's delivery address, or digitally via email if appropriate.

4. The prize is not transferable to third parties. The cash value of the prize cannot be paid out or exchanged for another prize. Winners are not entitled to any special condition of the prize.

5. If the winner withdraws from the prize, the organizer reserves the right to award the prize to another participant determined by the selection committee.

7 Rights and obligations of the organizer

1. The organizer reserves the right to exclude participants from the contest, to remove a contest work from the fan page or to deprive a participant of the right to the prize if their actions are against the law or morality, harm the legitimate interests of third parties or contradict the provisions of these Terms and Conditions of participation, especially if:

a. they do not act personally, but through third parties;

b. they are not of legal age;

c. claims are made by third parties in connection with their competition work, in particular with regard to the publication of a likeness of a person captured in the competition work or the infringement of intellectual property rights.

2. In order to clarify doubts regarding the participation of a participant in the competition, the organizer may contact the participant via the communication channel specified by the participant (e.g. by e-mail or via Facebook), with which the participant agrees.

3. The organizer is not responsible for the timely transmission and processing of information caused by the operation of Facebook or Instagram, technical problems or other computer malfunctions, failure of the Internet connection or other impairments of a technical nature.

2. Can I object to the data processing or withdraw my consent, and if so, how?

Yes, you can object to the processing of your personal data or withdraw your consent (see below section 9), but please be aware that this also means that you cannot participate in the contest anymore.

In any event, your personal data collected by us during the course of this contest will be deleted forty (40) days after the contest has ended.

3. What data is being processed and for what purpose?

The EU GDPR is an EU Regulation and is applicable for processing personal data in the European Economic Area. It no longer applies to the UK. In practice, there is little change to the core data protection principles, rights and obligations. (UK) GDPR recitals add depth and help to explain the binding articles.

4. To whom do we give the data further and for what purpose?

Where the prize is supplied by our promotional partners (external recipients), the promotional partners will receive this data.

5. Is there a transfer of data to a third country?

As a German company, we take data protection very seriously.

We may transfer your personal data to:

• other affiliated zooplus companies or third parties - e.g. promotional partners in connection with this contest;and

• third parties which provide IT services to us and which process such data only for the purpose of such services (e.g., hosting or IT maintenance and support services).

Any recipient will be located either in the UK, the EU, or a country that is covered by the EU adequacy decision.

Personal data published by you on social media may be globally accessible to other registered users of the respective social media.

6. How long do we save your data?

For forty (40) days after contest has ended.

7. Is the provision of personal data necessary for legal or contractual reasons?

Yes. Without your personal data, we cannot contact you in case you have won in this contest, and we cannot have delivered the prize to you.

8. Is there any automated decision-making on the basis of your personal data?

No, there is not any automated decision-making on the basis of your personal data or Profiling under Art 22 GDPR.

9. What rights do you have?

The data protection laws in the jurisdiction in which you reside may entitle you to specific rights in relation to your personal data.

In particular, and subject to the legal requirements, you may be entitled to

• Obtain from us confirmation as to whether or not personal data concerning you are being processed, and where that is the case, access to the personal data;

• Obtain from us the correction of inaccurate personal data concerning you;

• Obtain from us the erasure of your personal data;

• Obtain from us restriction of processing regarding your personal data;

• Data portability concerning personal data, which you actively provided;

• Object, on grounds relating to your particular situation, to further processing of personal data concerning you; and

• Withdraw your consent to our processing of your personal data.

10. Special Information about the right to object

1. Case-specific right of objection

You have the right, for reasons of your own situation, to object at any time to the processing of personal data pursuant to Article 6 (1) (f) GDPR (data processing based on a balance of interests). This also applies to profiling based on this provision within the meaning of Art. 4 No. 4 GDPR. for customer consultation and customer service and for sales purposes. If you file an objection, your personal data will no longer be processed unless zooplus proves compelling legitimate grounds for processing that outweigh your interests, rights and freedoms, or the processing is for the purpose of asserting, exercising or defending legal claims.

2. Right to object to the processing of data for direct marketing purposes (if applicable)

zooplus may also process your data for direct marketing insofar as we are allowed to under the law.

You have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising, without incurring other than the transmission costs according to the basic rates.

This also applies to the profiling, as far as it is associated with such direct marketing. If you object to the processing for direct marketing purposes, we will no longer process your personal data for these purposes. The objection can be made free of form.
